摘要
优化开发、重点开发、限制开发和禁止开发等四大类主体功能区是具有跨行政区域特性的基础性、战略性、约束性规划,其协调发展需要系统完善的法制作保障;我国目前的区域经济发展模式和政府绩效考核制度的惯性,使得主体功能区各行政区政府之间的有效深入合作和区域发展的和谐互补面临极大的挑战;"区域联合立法"是规范主体功能区内各行政区经济发展的新的立法形式,有利于克服目前存在的各行政区区域经济间重复建设、互不衔接和恶性竞争等问题,更好地为主体功能区内各行政区政府区域经济一体化进程提供指导规则和法律支持。
The four main functional areas which include the optimization of development, the focuses of development, the limited-development and the prohibition of development are basic, strategic and restrictive plannings that have a cross-administrative regional characteristics, of which the coordinated development must be supported by the system of law. Because of Chinese mode of regional economic development and the government performance appraisal system inertia at present, there exists a big challenge to realize the effective cooperation between the main functional areas of each administrative region government and the harmonious regional development. The regional united legislation is a new form of legislation to regulate the main functional areas within the administrative area economy development, which is beneficial to overcome the problems of the administrative region economy to repeat construction, the inconsistent and the blind competition, and to provide guidelines and legal support for the government of the administrative region in the main function areas for the regional economic integration.
