论武警自由裁量权及其控制

On the Discretion of CAPF and Its Control

武警部队行使职权具有一定的自由裁量空间,形成了武警自由裁量权。武警自由裁量权的存在既有法律上的原因又有其客观基础。在我国法治建设的背景下,应当对武警自由裁量权进行有效的控制。就控制方式而言,外部控制包括权力机关、行政机关以及公民、法人和其他组织的控制;而内部控制主要是依靠部队加强军事行政管理来实现,具体包括执行严明的纪律、加强日常秩序管理、实施警备纠察制度等。

There has been some freedom when CAPF enforces its authority, which forms the discretion of CAPF. Its existence results from the legal and the objective reasons. Within the background of the construction of rule of law in China, the discretion of CAPF should be effectively controlled. In terms of its ways, external control includes power organs, administrative organs, citizens, legal persons and other organizations; internal control mainly depends on the force to strengthen the military administrative management consisting of the implementation of strict discipline, the strengthening of management of daily orders and the enforcement of the system of picketing of the guards.
