摘要
私生活是维护人性尊严、人性自由与个性发展的需要。私生活权利得到了国际人权公约与地区性人权公约确认。私生活权利保护的重点与难点在于私生活权利范围与内容界定、国家相关义务、私生活权利的限制。平等原则与平等权利为中国目前婚姻权与成立家庭权利的保护,如伴随婚姻关系所产生的婚姻利益、同性恋问题、生育权等问题的解释与解决提供了启示。
Private life is intended to secure space for individual dignity, freedom and development, and the right to private life is reflected in the law of international human rights and regional human rights, and the content and scope and limitation and duty of the right presents sets of puzzles. Equal access provides a sensible way for the right to marry and to found a family in China to understand the issues of material benefits accompanying the marital relationship, homosexuality and the right to procreate or to adopt Children.
