加拿大萨省矿业权管理法律制度浅析

Analysis on the legal system of the mineral right management of Saskatchewan in Canada

为进一步研究学习国外矿产资源管理经验,本文对加拿大萨斯喀彻温省矿产资源法律体系、矿业权管理主要制度进行了分析研究,重点阐述了萨省矿业权的种类、取得方式、相关权利和义务等制度的内涵。提出了加强矿业权权益保护立法,进一步明确资源配置、权益分配等重点环节的管理流程、标准和内容,不断完善矿业权法律法规体系的相关建议,为进一步完善我国矿业权管理和立法提供参考。

For further research and study on the management experience of foreign mineral resources, the legal system of mineral resources as well as the main systems of mineral right management in Saskatchewan is analyzed in this paper. The types of mineral rights, the modes of acquisition as well as the connotation of the systems concerning rights and obligations in Saskatchewan are mainly elaborated. The suggestion of strengthening the legislation of rights and interests of the mineral rights protection is put forward, and the management processes, standards and contents of the key aspects such as the allocation of resources and the equity allocation are further clarified, Recommendations concerning laws and regulations system of mineral rights are constantly improved, providing references for further improvement of mineral right management and legislation in China.
