简析法治的概念

A Conception Analysis of Rules by Law

本文通过对中外法治一词的分析 ,阐释了法治的概念。法治一词在古代汉语中主要是指垂法而治、圣法之治和法不阿贵 ;在现代汉语中主要指依法治理。在西语中 ,一般认为法治是与专制对立的治国方式。通过分析认为 ,法治是一种宏观的治国方略 ;一种理性的办事原则 ;一种理想的管理模式 ;

<abstract>This article expounds the concept of the rule of law through careful analysis of the term—the rule of law—both in Chinese and in Western languages.In the old Chinese,the term rule of law means goveming according to law,ruling according to the laws,set by wise men and that law doesn't submit itself to the peer.In modem Chinese,it mainly means governing by law.In westem languages,rule of law is generally regarded as a way of goveming a country which is opposite the monarchy.Through analysis the author concludes the rule of law is a macroscopic strategy of ruling a country,a rational principle of operation,an ideal management model and a ruling pattern which limits the monarchy
