摘要
本文从国企所有权的构造性特征入手，考察了国企所有权的宏观权能和微观权能及其权能要素，论证了把宏观权能赋予国家和把微观权能赋予劳动者群体，从而重塑国企所有权制度—国企所有权分权构造原则，并阐明这是国有企业的制度根基和国企改革的根本问题。
Starting with the structual features of state ownership, the author studies the factors of both macroand micro rights of state ownership, and discusses the principle of dividing the right Structure: macro rights be-longing to the state while micro rights to the workers of stae enterprices.
