科层制还是民主制?——改革年代全国人大制度化的内在逻辑

Bureaucracy or Democracy? On the Logic of the National People's Congress' s Institutionalization during the Reform Years

改革以来,全国人大的制度化建设取得了长足的进展,也因此大大提升了其在国家政治生活中的地位与作用。但与此同时,全国人大的制度化建设并未将其真正塑造成为宪法赋予的最高国家权力机关。这是因为:全国人大制度化建设中过分偏重提高行动效率的"科层制逻辑",使其偏离了作为最高国家权力机关的发展方向,从而在相当程度上制约了其成长的空间。因此,未来全国人大的成长应该在现有制度建设基础上凸显"民主制的逻辑"。

Since the reform,the institutionalization of the National People's Congress has made considerable progress,thus its status and role in the national political life are greatly enhanced.Meanwhile,the institutionalization of the National People's Congress can't make it truly become the highest organ of state power endowed by the constitution.This is because the National People's Congress institutionalization puts too much emphasis on the bureaucratic logic for improving the efficiency,and it has deviated from the direction as the highest organ of state power,restricting its development space to a considerable extent.Therefore,the future of the National People's Congress should highlight the 'democratic logic' while bases itself on the existing syetem.
