摘要
小产权房市场规制的体制综合症,深刻折射出社会转型期法律的缺失或不适,触及到集体土地产权、公民迁徙与住房权利、行政公权行使等宪政问题,陷入了既要重申和维护行政公权的权威性与行政措施的有效性,又陷入无法可依、违法难究、重典严禁而屡禁不止的宪政困局。破解的根本之道,主要是通过修宪或释宪说明的体系性措施,整合修订相关法律或补充立法,立法机关授权行政机关发布行政政策措施或出台过渡性制度安排的方式,将小产权房市场从灰色、模糊的法律边缘状态,导入宪政法治轨道。
The problems and conflicts arising out of the issue of "impaired ownership property" reflect systemic legal failure and deficiency. Collective ownership of land, migration and migrants housing needs, administrative power and efficacy are problems that point to legal vacuum and create difficulties with effective intervention of administrative authority, weakening the government's trustworthiness and respectability. The only way out are systemic efforts. Revise the constitution or promulgate constitutional amendments or opinions will create a legal environment that will allow "impaired ownership properties" to be firmly incorporated into legal and administrative regulation.
