反渎侦查一体化建设的探索与实践——以红河州检察院反渎工作为例

Exploration and Practice of Integrated Construction of Anti- Malfeasance Investigation——Based on Anti- Malfeasance Work in People's Procuratorate of Honghe Prefecture

反渎职侵权侦查一体化是检察机关为优化侦查资源配置、提高反渎整体办案效能,采取以侦查指挥中心为组织形式,以提办、交办、参办、督办、异地指定管辖等为主要办案方式,以上一级检察院侦查指挥中心作为本地区职务犯罪侦查的指挥平台,整合上下级检察院反贪力量,实现办案的规模与效应,达到预期办案效果和社会效果的一种侦查模式。2010年以来红河州检察院反渎职侵权局积极推行侦查一体化办案机制,形成全州查办渎职侵权犯罪案件一盘棋的侦查格局,全州反渎职侵权部门成功开展反渎专案工作,查办了一批有影响、有震动的案件,特别是在查处黑恶势力保护伞案件中取得了显著的成绩,达到了法律效果、政治效果和社会效果的有机统一。

Aiming at optimizing resource distribution of investigation of procuratorates, and enhancing efficiency of handling malfeasance cases, integrated construction of anti-malfeasance investigation means a kind of case-handling mode which based on investigation commanding center, integrating case reporting, task assignment, supervision on handling, designated jurisdiction of different places, and etc.. While setting higher authority of procuratorate as commanding center for the investigation of malfeasance cases of certain area, all resources of both superior and subordinate investigation bodies could be integrated. It could further lead to a desired case-handling result and social effects. Ever since the year of 2010, People＇s Procuratorate of Honghe Prefecture has initially carried out integrated investigation mechanism, which has integrated sources over whole Honghe Prefecture to counter malfeasance crimes. All agencies in charge of anti-malfeasance investigation are working together, and have cracked down several influential big cases, especially some gang and organized crimes, which has demonstrated an integration of law effects, political effects and social effects.
