On the Judicial Independence in China with Case-Study

司法独立是现代法治国家普遍承认和确立的一项基本法律准则,其涵盖面非常广泛。本文从典型个案药家鑫案着手,将司法独立限定于审判独立这一较小视角,对可能影响审判独立的非法治因素(被害人、民众、媒体、公知、政党)逐一分析,并对各因素间的牵连关系加以论述,试图以此寻找实现司法独立的突破口。

Judicial independence is generally accepted by the modem country under the rule of law and the establishment of the basic legal principles, which covers a very wide range. This text sets about from the typical case, is limited to a smaller trial independence perspec- tive on the judicial independence, analyses factors （the victim, public, media, public knowledge, political parties） one by one which affect the trial independence, and the implications for relations among these factors, and is trying to find some implementations in the process of such breach of trim independence.
