摘要
当代中国的法学教育应该加强实践性,但人们对于实践性的认识却有着非常大的局限性,而真正的实践性包含了目的性与实践智慧。真正的实践是要解决普遍与具体的矛盾,并在其中展示人类自身的智慧。中国当下的判例教学和法学教育的时代性都存在着严重的局限性,并没有真正契合实践的本性,而法学教育的改革应该真正体现实践的本性。法学教育的本土性比国际化更符合实践的本性。
Practicality should be greatly strengthened in the contemporary legal education, but scholars formed different knowledge about practice. The real practice contains purpose and phronesis, which try to resolve the contradiction between generality and specialty, and practical wisdom can be spread out in the practice. The contemporary case teaching of legal education does not correspond to the nature of practice, and the reformation of legal education should tally with practicality. The localization of legal education conforms to the nature of practice more than internationalization.
