Negative Impact of the Idea of “Compensating Crime with Rank”on Modern Legal System and Its Countermeasures

作为封建特权思想典型的"官当"思想,现今依然严重影响着中国的现代法制建设。官当制度起源于春秋战国、确立于魏晋南北朝、消失于元朝,其设立的最根本原因是对于封建等级特权的维护;官当制度的特权思想对当今我国社会的政治、法律制度有根深蒂固的负面影响,所以,肃清"官当"流毒,对建设法治社会具有积极的意义。

The idea of ＂compensating crime with rank＂ as the feudal privilege typical thought still seriously affects the modern legal system construction in China.It originated in the Spring and Autumn and Warring States Period,was established in the Wei Jin Southern and Northern Dynasties,and disappeared in the Yuan Dynasty.The most fundamental reason of its establishment was to maintain the feudal privileges,and this system has ingrained negative impact on the development of our country＇s politics and legal systems.Therefore,it is an urgent task to clean up the harmful effect of the system and to construct constitutional society.
