The Origin of Law and Its Nature of Ideology

人民为什么要遵守法律?法律的要求、惧怕制裁、心理上的惯性、社会压力、道德的义务这些或单一、或交织的元素在给人们带来答案的同时,也带来了更多的困惑。马克思主义认为,只有认识到法的意识形态性才能从根本上寻找到人们守法的内在原因。法的意识形态性是法的本质特征,包括三层含义:国家意志、物质生活条件决定性、多元因素影响。法的意识形态性在不同的历史条件下表现各异,但从根本上规定了人们守法的意愿及效果。

Why should people obey the law？ Legal requirements, fear of sanctions, psychological in- ertia, social pressure, and moral obligation that these or single, or interwoven elements bring answers, but it also brings more confusion. Marxism believes that law＇s ideology is the key to finding the under- lying causes of which people obey the law. The ideology of law is the essential characteristic of law, and it contains three meanings： National will, the decisive factor of material living conditions, and the influ- ence of multiple factors. The ideology of law is different in different historical conditions, but it funda- mentally stipulates the intention and the effect of people.
