贯彻《防洪法》“谁设障,谁清除”原则的几点思考

在贯彻实施《防洪法》“谁设障 ,谁清除”原则时 ,要区分历史遗留障碍物和违法违章障碍物 ,以便正确适用“谁设障 ,谁清除”原则。特别是历史遗留障碍 ,由于历史原因 ,设障情况更是复杂 ,应区别对待 ,同样 ,对于违法违章障碍物 ,也须分清谁是真正的清障责任人。
