摘要 案例教学法源于一百余年前兰德尔在哈佛大学法学院发起的法学教育改革。自其创始以来,在美国法学教育中起着举足轻重的作用,并成为美国法学教育的重要特征。从案例教学法产生的历史背景、教学形式以及精神实质等方面展开论述,分析案例教学产生发展的核心因素为培养法科学生"像律师一样思考"的思维与实践能力,对我国法学教育具有一定的借鉴意义。 A century ago, Langdell's legal education reform at Harvard Law School created the case methodology. The case methodology played a more and more important role in American legal educa- tion and finally characterized American legal education. This article analyzes the historic background during the birth of the case methodology and how it is conducted pedagogically and the essential ideas supporting its development, aiming at providing some foreign experiences for the legal education in China.
