我国工伤保险理论研究综述

Review on Chinese Work-related Injury Insurance Theoretical Study

全面分析我国近年来工伤保险研究相关著作,重点结合代表性的期刊论文,发现国内相关研究主要是从经济管理、法学和国际比较三个角度来展开。迄今为止,我国工伤保险理论基本上是以制度设计为重点,就参保对象、工伤认定、劳动能力鉴定、工伤保险待遇、工伤保险争议处理、工伤预防、监督检查等制度要素展开研究,为我国工伤保险研究提供了比较完整的研究框架,又为工伤保险立法提供了急需的理论指导。同时,还较全面的介绍了德国、美国、日本等代表性国家的工伤保险制度,为我国提出了有价值的参照对象,对于我国工伤保险事业起到了较积极的指导作用。然而,我国工伤保险理论研究整体上还比较薄弱,在多个方面需要进一步努力。

The past decade has witnessed a remarkable growth in work-related injury insurance research,both in scope and in depth.This paper is aim to understand the status quo and progress of Chinese work-related injury insurance theoretical study by surveying about scientific literature in this academic fields.Almost all researches discussing on different aspects of the problem and in different practice settings and academic fields fall into three main groups： economic and managerial study,legal study and international comparative study.So far,most researches focus on work-related injury insurance system construction,covering some issues,such as insurance beneficiaries,work injury certification,compensation,work-related injury insurance dispute,vocational injury prevention,safety inspection,etc.Those researches provided the theory direction needed for Chinese work-related injury insurance legislation,and comprehensively introduced the experience of different countries such as United States,Japan,Germany and so on as valuable reference for our practice.However,on the whole research in China is still relatively poor,needing further efforts in many aspects.
