职业体育俱乐部保障职业运动员劳动权利的法律义务

Professional sports clubs' legal obligation to ensure professional athletes' labor rights

在比较欧美等国相关法律制度的基础上认为,职业体育俱乐部有义务保障职业运动员自由权属性的劳动权,并有义务对职业运动员休息休假、安全卫生、代表本国参赛等社会权属性的劳动权予以合理保障。结合我国实际,提出职业运动员的基本法律地位是劳动者,应给予职业运动员更充分的自由流动权利等建议。

On the basis of comparing related legal systems of European and American countries, the authors con- cluded that professional sports clubs are obligated to ensure professional athletes＇ labor rights with a freedom right attribute, and to rationally ensure professional athletes＇ labor rights with a social right attribute, such as rest and va- cation, safety and sanitation, participation in competitions as national representatives etc. Associating with actual circumstances of China, the authors put forward some suggestions, such as professional athletes should be given the right to change their owners more freely since the basic legal status of professional athletes is laborer.
