Comparative Study between BOT and BT Model about Infrastructure Projects

作为基础设施项目建设的投融资建设方式,BOT和BT模式是基础设施项目引入外资或私有资本的具体表现。BT模式属于BOT模式的演变发展形式,二者在经济实质、目标、最终所有者、风险转移、政府控制力度、参与者等方面有着较大的共性,而在运作过程、适用范围、定价及投资回收方式、项目移交时间、风险分担、监管难易程度、会计处理、税收政策等方面又存在较大差异。应正视BOT和BT模式的比较界定,准确把握其经济实质和运作机制,完善相关法律制度,积极推动BOT和BT模式的应用与发展。

As investment and financing construction methods of infrastructure projects, BOT and BT model are concrete manifesta- tion of introduction of foreign capital or private capital to infrastructure projects. BT model is evolved in the form of BOT model, and there are big common of both in the economic substance, target, ultimate owner, risk transfer, government efforts to control, participant and other aspects. But there is also a big difference between them in operation process, scope, pricing and investment recovery methods, project over time, risk - sharing, regulatory, accounting, tax policy and other areas. We should address the comparison BOT and BT model defined, accurately grasp the essence of their economic and operational mechanisms, and improve relevant legal system to actively promote the applications and develovment of BOT and BT model.
