本土意境下中药复方专利的涅槃场域——以中医药学原理为研究路径 被引量:6

Discussing on the creative identification of the compound patents of Chinese traditional medicine——Taking traditional Chinese medicine theory as the research path

摘要 随着中药复方专利侵权案件的日益增多,人们对中药复方专利的创造性认定问题展开了激烈讨论,但至今仍无定论,我国现行《专利法》也不能为我们提供直接指引。在这种情况下,应当把《专利法》与中医药的相关原理相结合,只要新中药复方对现有中药复方专利的药味、药量、炮制方法、给药途径、生产工艺和方法、组合物、混合物、药用部分、复方组合、中药产地、煎药方法、煎药时间、服药方法、饮食禁忌等方面作出改变和完善,且能够在提高疗效、减少毒副作用、改变主病主症、适应同一病症的不同类型等任何一方面有所突破,就应当认定其对中药领域的普通技术人员来说具有"非显而易见性",有"突出的实质性特点和显著的进步",符合专利创造性认定要求。 With the growth of the infringement cases of the compound patents of the Chinese traditional medicine, people made a fierce discussion on the creative identification of the com- pound patents of the Chinese traditional medicine , but the final conclusion has not been made yet , and the current Patent Law in our country can not provide direct guidance for us. Under the circumstance, we should combine Patent Law with the relevant principles of Chinese traditional medicine , as long as the new compounds of Chinese traditional medicine compared with the ex- isting compound patents of Chinese traditional medicine can make some changs and improvements in dose, processing methods, giving routine, producing processes and methods, composition, mixture, medicinal part, combining compounds, the origin of the Chinese traditional medicine, decocting time, decocting methods, methods of taking medicine, food taboos , and so on , be- sides, they can make a breakthrough in any aspects in improving efficicency, reducing side effect, transferring the main diseases and symptoms , adapting to the different types of the same disease and symptom , and so on , which shall be deemed "non -obviousness" to ordinary techni- cians in the field of traditional Chinese medicine, own "prominent substantive features and signif- icant progress" and accord with the requirements of patent creative identification.
