论公众人物隐私权与大众知情权的冲突与协调

On the conflict and coordination between public person's privacy right and the public's right to know

一般而言,权利的自由行使建立在不侵害他人合法权益的基础上,但公众人物的个人信息往往涉及公共利益和公民的合理兴趣,对公众人物隐私权的保护限制恰恰是对社会知情权的宽容与延伸。协调公众人物隐私权与大众知情权的冲突须坚持维护社会公共利益原则、保护公众人物人格尊严不受侵犯原则、满足公众合理兴趣原则,并在具体的个案中权衡利弊,从而实现两者在个案中的利益平衡。

Generally,the realization of one person＇s right must＇nt infringe other one＇s legal rights and in- terests. Since the personal information of public fig- ures often involves public interest and citizen＇s rea- sonable savour,to restrict public figures＇ privacy is just to extend the right to know of the public. To coor- dinate the conflict between the right to privacy of public figures and public＇s right to know should obey such following principles：uphold the public interest, protect public figures＇personal dignity, satisfy pub- lic＇s reasonable interests and weigh the pros and cons in the specific case in order to achieve the balance of those two important rights.
