经济法学教学与民法学教学之比较

Comparison between Economic Law Teaching and Civil Law Teaching

在国内法体系中,经济法与民法这两个法律部门关系最为密切。民法是传统法,经济法是典型的现代法,民法学的教学体系对经济法学的教学将产生重要影响。以民法教学为参照物,研析经济法学教学具有重要意义。民法学教学内容上,轻总论基础重分论具体制度,教学目标上,轻理论认识能力而重实务操作能力,教学方法上,轻理论阐释而重案例讲解,教学体系上,轻横向关联重纵向考察。由于经济法研究与民法研究相比较而言,存在着理论不成熟不系统、总论分论脱节严重、研究对象不稳定等问题,因而经济法学教学与民法学教学在教学内容、教学方法、教学体系等方面应当有所不同,应当重其所轻,轻其所重。

In domestic law system, the department of economic law most closely relates to the department of civil law. The civil law is traditional, but economic law is typical of modern feature, thus the teaching system of civil law will have an important impact on the teaching system of economic law. As a reference to civil law teaching ,it＇s important to analyze the economic law teaching. The teaching of civil law has the following characteristics as attaching more importance to points on the specific system than remarks based in teaching content, preferring practical operation capability over cognitive theory ability in teaching objec- tives, looking up to the explain of Case and down on theory analysis in teaching method and regarding lon- gitudinal study as superior to lateral association in teaching system. Compared with the study of civil law, the study of economic law has some problems, such as immature theory, a serious gap between general re- marks and points and study object unstable. So economic law teaching should be different from the civil law teaching in the teaching content, teaching methods, teaching system, and so on.
