摘要
我国现行土地制度下,石油天然气设施用地征用方式与流程比较复杂。土地有偿使用后,提高石油天然气设施用地配置效率和效益是土地制度改革的必然要求。本文探讨了"流转制"、"年租制"和"入股制"三种土地有偿使用方式,并分析了政府、石油天然气企业和农地使用权人在土地有偿使用模式下的权责利,将明确的土地产权、简单的交易方式和有针对性的用地体制确定为探讨石油天然气设施用地有偿使用的基本要素。
Under China's current land system, the methods and procedure of expropriating land for use of oil & gas facilities are fixed but complicated. Since land use is compensated, it becomes an inevitable requirement of the land system reform for oil & gas facilities to enhance their land allocation efficiency and effectiveness. The paper discusses the three methods of compensated land use, i.e. "circulation system", "rent system" and "shares system", as well as analyses the respective rights, responsibilities, and benefits of the government, oil & gas enterprises, and land-use owners under the model, while determining clear land-use ownerships, simplicity in land trade, and targeted land-use policies as the basic elements in the discussion of compensated land use for oil & gas facilities.
