我国公司型基金的设立及其立法

随着我国金融投资行业的蓬勃发展,引入公司型基金将是我国金融投资行业发展的重要趋势。由于利益因素和立法因素,目前,我国的证券投资基金并未采用相对公平合理的公司型基金形式,而是采用契约型基金形式。为扩大投资基金规模,增加投资基金品种,满足投资者个性化的投资需求,保障投资者的合法权益,推动金融投资行业的健康发展,应当借鉴国外发展公司型基金的经验,加快公司型基金的设立,完善相关立法。

With the prosperous development of financial investment industry, introduction of corporate funds will be an important trend for its development. Due to interest factors and legislative factors, currently China＇s secu- rities investment funds haven＇t adopted relatively fair and reasonable corporate funds; instead, we are taking the contractual funds. In order to expand the scale of investment funds, increase more types, satisfy investors＇ needs, protect investors＇ legitimate rights and interests, and promote the healthy development of the financial investment in- dustry, we should learn from foreign experience, accelerate the establishment of corporate funds, and improve the relevant legislation.
