《物权法》之预告登记制度探微

A Discussion on the System of Advance Notice Registration of the Property Law

我国《物权法》第一次以立法的形式对预告登记制度加以确立,但立法过于笼统。文章通过对《物权法》中预告登记制度的适用范围、形式要件、效力及失效四个方面进行研究与分析,提出实施预告登记所需要完善的细节问题,以期进一步完善我国的预告登记制度。

The Property Law of China established the system of advance notice registration in the form of legis- lation for the first time, but far too general. This article analysis the system of advance notice registration from four aspects：range of application ; formal requirement ; efficacy and the losing of efficacy. Then puts forward the details needed to be impleted for the advance notice registration, in order to improve the system.
