社会矛盾化解视域下检察调解制度解构

Resolution of Attorney Mediation System in the Perspective of Social-Conflicted Deconstruction

检察调解是检察机关在履行职能的过程中，根据当事人的意愿依法对当事人双方予以调解的工作方法。目前，检察机关在开展调解时由于缺乏法律依据及相应的监督机制，亟待确立检察调解制度的法律地位、法定程序和监督机制等。

Attorney Mediation is the working method, which regulates contradictions between parties according to their wishes with the law used in performance of functions of procuratorial organs. Currently, because of the lack of legal basis and appropriate supervision mechanism, procuratorial organs need establishment of the legal status of the Attorney medi- ation system, legal procedures and supervision mechanism urgently.
