论我国社会养老服务机构的法律规制

Regulations on Social Institutions for Old-aged Care in China

随着我国人口老龄化发展进程的加快，大力发展多种形式的社会养老服务机构成为缓解养老服务供需矛盾的有效手段。现阶段的养老服务机构自身存在分类混乱、资金匮乏、管理体系不明、人员缺乏、风险巨大的发展困境，迫切需要法律规制和引导．鉴于《老年人权益保障法》在规范社会养老服务机构方面存在空白，建议通过在《老年人权益保障法》中增加“社会养老服务机构”一章，对社会养老服务机构的分类标准、准入、管理等作原则性规定，具体内容则通过引致条款援引其他相关法律规范．

With the quickening process of the aging of population in China, promoting all kinds of social institutions has become an effective means to provide services for the elderly. But the existing institutions for old-aged care confront many problems： confused classification and management, lack of funds, shortage of nursing aids and existance of great risks. The social institutions for old-age care need to be specified. However there is a vacancy in the Law of the People＇s Re- public of China on the Protection of Rights and Interests of the Aged. Therefore, it is suggested to supplement a chapter of＇Social Institutions for Old-aged Care＇ in the above law to establish prinsiples and standards on classification of such institutions, attendance to these institutions, including services, supervision and management. The specific clauses of the chapter can be formulated in quotations from the related laws.
