应对灾害提供保护的框架原则及其构建完善

On Framework Principles and its Construction Perfection of Addressing Disasters and Offering Protection

当今的人类社会各种灾害频繁发生,凸显了在国内和国际层面加强"灾害应对"与"提供保护"的迫切需要。近年来,联合国国际法委员会开始编纂、发展"应对灾害提供保护"的国际法原则和规范,在这方面已经初步形成了一些主要的框架原则和要素。中国的实践顺应了这些框架原则、要素的要求,同时,中国应当根据自己的价值观和利益需求来诠释和完善"应对灾害提供保护"领域的框架原则与要素。

Nowadays disasters happen in a frequen way,which leads to urgent demand of ' in response to disasters,providing protection' at both domestic and international level.In recent years,International Law Commission has been codifying and developing international law principles and norms concerning ' in response to disasters,providing protection',which has primarily formed some main framework principles and elements.China' s practice complies with these framework principles and elements.At the same time,China should interpret and perfect framework principles and elements in the area of ' addressing disasters and offering protection' by China's own values and interest.
