刑事诉讼法修改背景下的职务犯罪侦查工作

Duty Crime Investigation under the Background of Amendment of Criminal Procedure Law

2012年刑事诉讼法在人权保障、证据意识和程序控制方面做出了重大修改,其对检察机关职务犯罪侦查工作的影响,表现在犯罪嫌疑人辩护防御权的扩大,讯问过程体内监督的加强,非法证据排除规则的落实,技术侦查手段的入法等方面。为应对刑事诉讼法的修改,检察机关应当转变观念,正确面对辩护律师的介入,建立一套严密的避免非法取证的侦查防范机制,运用多种侦查手段,提高收集证据的能力,完善职务犯罪侦查工作。

In 2012,the Criminal Procedure Law was amended in the aspect of human rights protection,evidence consciousness and process control.In response to the impact,the procuratorial organ should change ideas,face the intervention of lawyer,establish a set of rigorous investigation mechanism to avoid illegal evidence,improve the ability of collecting evidence using a variety of investigation methods,in order to push the duty crime investigation.
