乔装侦查、控制下交付中的犯罪特殊形态

Special Crime States in Covert Investigation and Controlled Delivery

乔装侦查是指为了查明案情,由有关人员隐匿其身份实施侦查;对涉及给付毒品等违禁品或者财物的犯罪活动,公安机关根据侦查犯罪的需要,可以依照规定实施控制下交付。按照刑法总则原理,犯罪的特殊形态包括犯罪预备、犯罪未遂以及犯罪中止。在犯罪未遂中又分为能范未遂和不能犯未遂。二者区别在于行为在客观上是否具有危害性。依此,在警察实施的乔装侦查和控制下交付两种策略中,根据实施的具体情况不同,会导致行为处于犯罪预备、能犯未遂或者不能犯未遂的不同阶段。

The covert investigation refers to the implementation of the investigation in order to clarify the circumstances of a case,concealed its identity by an officer;controlled delivery refers to police officer takes a method on giving drugs or other things prohibit by law,as well as money.Special crime states consists of crime preparation,attempted crime and discontinuance of crime,by crime law the theory of criminal law.Besides that,attempted crime consists of possible attempted crime and impossible attempted crime,the difference of which is whether harmful in objective action.Therefore,in two methods taken by policemen,there are crime preparation,possible attempted crime and impossible attempted crime,under different states and place.
