摘要
海法体系是指由各种涉海法律规范相互协调与衔接而组成的结构完整、内容广泛、层次分明的法律体系。在中国建构海法体系具有必然性,能够满足进一步完善中国社会主义法律体系、有效保障和促进中国海洋权益、尊重海法发展客观规律等方面的要求。构建完善的海法体系应当采取加速中国海法体系的立法进程、进一步深化中国海洋执法机构改革、逐步调整中国海洋司法制度等措施。为了推动中国海法体系的可持续发展,还应注重明确和完善中国海洋政策、加强海法体系理论研究以及海洋人才培养。
The system of laws of the sea is a legal system with integral structure and sweeping content consisting of all norms relating to the sea. It is necessary to build China＇ s system of laws of the sea because it can perfect China＇ s socialist legal system, protect and promote China＇ s maritime rights and interests, and respect the objective law of the sea laws. For this purpose, China shall accelerate the relevant legislative process, deepen the reform of the maritime enforcement agencies, ad- just the marine judicial system. In addition, in order to realize sustainable development of sea laws, China must set a clear and thorough ocean policy, enhance the theoretic research on laws of the sea as well as ocean education.
