船舶扣押的正当性探讨

On the legitimacy of arrest of ship

从正当性视角出发,以当事船扣押和姊妹船扣押为研究对象,分析立法和司法在船舶扣押程序中与正当性相关联的因素,指出船舶扣押程序存在的合法性及合理性问题,提出船舶扣押的正当性标准。对禁止重复扣押之立法正当性进行解析,并对允许重复扣船的三种情形进行正当性考察,提出判断其是否具备正当性的三个标准。

From the perspective of legitimacy, this article takes the ship arrest and sister ship arrest as the object of study, fo- cuses on the relationship between ship arrest procedure and associated legitimacy factors in terms of legislation and judicial practice, points out the legitimacy and rationality of the ship arrest procedure, sets a test standard on the legitimacy of the ar- rest of ship, analysizes the legislation of prohibiting repeatable ship arrest and allowable arrest of ship, raises the three spe- cific standards for judging the legitimacy.
