摘要
随着老龄化社会的到来,养老问题已经成为重要的社会问题。特别是农村,养老问题越来越突出,因赡养问题而引发的法律纠纷呈上升趋势。我国现行赡养法律制度对保障老年人权益起到不可忽视的作用。但在农村,目前这种建立在对人的信任基础上的法律制度不能很好解决农村养老问题,适合农村的养老法律制度应该是建立在对财产信任基础之上。因此,本文在对现有赡养法律制度和农村实际养老现状分析的基础上,提出完善赡养法律制度,建立农村新型养老模式。
With the arrival of the aging society, the pension problem has become an important social prob- lem, especially in the countryside; which is becoming more and more serious, due to maintenance problems and legal disputes being on the rise. China＇s current legal system of maintenance plays an important role to guarantee the rights of the elderly, which can not be ignored. But in the current rural area, the legal system based on the trust of the people cannot solve problem of rural providing for the aged, properly, while the suitable legal system should be established on the foundation of trust property. Therefore, based on the a- nalysis of existing legal system of maintenance and rural practical status quo, this paper proposes to perfect legal system of maintenance, to establish a new rural pattern of providing for the aged.
