面向可持续发展的自然资源法与环境保护法的比较研究

Research on the Relationship between The Natural Resources Law and The Environmental Protection Law in the Face of Sustainable Ddevelopment

自然资源法与环境保护法作为同一法律部门的两个孪生姐妹 ,既有物质体系上的一致性 ,又有相对于人类生产、生活功能上的差异性 ;既彼此独立 ,又相互依赖。从两者的立法基础、调整对象、基本原则、基本制度等几个方面进行比较 ,指出在可持续发展战略旗帜下 ,两者结合发展的必然趋势。

As twin sisters in the same law system,The Natural Resources Law and The Environmental Portection Law have both similarities in material system and distinction in the aspect of the funcitions of human production and life.They are both independent and interactive.This paper compares them in the following aspects:the foundation of legistation,the objection of adjustment,the fundamental principles,the fundamental systems etc,and concludes that the two laws will inevitably combine with each other with the sustainable development strategy as the guidance.
