A Brief Analysis of Negative Impact on Modern Legal System from the System of Compensating Crime with Rank and its Countermeasures

作为封建特权思想典型的官当思想,现今依然严重影响着中国的现代法制建设。文章分析了官当制度的演变、形成的原因、社会历史条件以及对现代法制的消极影响等问题,并在此基础上提出了应对措施。

Compensating Crime with Rank, the typical example of the feudal privilege, has been influencing the construction of modem legal system in China. This paper analyzes such problems as the evolution of the Compensating Crime with Rank system, the cause of its formation, the social and historical conditions and the negative impact on modem legal system, and also puts forwardsome countermeasures.
