Free Trade Agreement and International Environment of Intellectual Property

自由贸易协定(FTA),在WTO的框架中被纳入区域贸易协定RTAs。发达国家和地区,充分利用FTA机制,企图绕开WTO机制,大力推行所谓"TRIPS-Plus"(超TRIPS条款),进一步大幅度提高知识产权保护的水平,这一现实及其对世界知识产权环境的影响是不容忽视的。在介绍有关自由贸易协定(FTA)的基本情况、类型的基础上,分析自由贸易协定(FTA)与世界贸易组织(WTO)的法律关系,从3个层次上探讨自由贸易协定(FTA)对世界知识产权制度和法律环境的影响,提出如何应对这一影响的初步设想。

Free Trade Agreement is included in Regional Trade Agreements in the framework of the WTO. The facts that developed countries and areas make the most of Free Trade Agreement and avoid the WTO system in order to substantially improve the protection of intellectual property by implementing the so-called ＂TRIPS- plus＂provision can not be ignored, as well as its effects on the international environment of intellectual property. This paper analyzes the relationship between Free Trade Agreement and the WTO after introducing some basic information and forms of Free Trade Agreement. And this paper discusses how Free Trade Agreement influence the international intellectual property system and legal environment from three different levels and it also puts forward some suggestions to deal with the influence.
