摘要 新《商标法》在完善私权保障的同时,更多地保障了公共利益,包括消费者利益与经营者正当竞争利益等。在商标使用制度、注册商标转让制度与驰名商标制度的完善上,这种倾向更加明显。新《商标法》明确了商标使用的目的,能够保护商标符号公共资源,维护经营之间的公平竞争。其将注册商标转让的限制与核准规则做了统一规范,有利于避免消费者混淆,促进市场正当竞争。为了更好地保护消费者利益,防止不同经营者通过驰名商标的心理暗示进行不正当竞争,新《商标法》规定了驰名商标的限制制度,包括驰名商标认定情形、驰名商标标记使用的限制等。 The new Trademark Law tends to protect public interests, including the interests of consumers and the fair competing interests of operators, with improving the protection of private rights. This tendency is more evident in improving the systems of trademark use, registered trademarks transfer and well-known trademark, it defines the purpose of trademark use, which can protect public resources of trademark and maintain fair competition between operators. It sets standardized rules on the transfer and approval of a registered Irademark, which can help to avoid consumer confusion and facilitate market legitimate competition. In order to protect the interests of consumers better and prevent unfair competition between different operators by using the psychological implications function of well-known trademarks, it sets limits to well-known trademarks, including conditions of identification of well-known trademarks and restrictions on the usage of weU-known trademark tag.
