我国专利实质条件的改进建议

Recommendations on the Improvement of the Patent Substantive Conditions in China

美国TPP知识产权草案没有把有益的技术效果或其他积极效果作为专利实质条件的构成要件,欧洲、日本与其基本一致,而我国有所不同。与此相应,我国专利实质条件方面存在的主要问题有三:一是创造性之"显著的进步"多余;二是实用性之"能够产生积极效果"该弃;三是创造性判断之"预料不到的技术效果"越位。解决这些问题的方案是,删除创造性之"显著的进步"、实用性之"能够产生积极效果"的要求,将"预料不到的技术效果"回归创造性判断的辅助考虑因素。

In Trans-Pacific Partnership Intellectual Property Rights Chapter Draft, ＂Beneficial Technical Effect＂ and other positive effects are not treated as the elements of Patent Substantive Conditions. In Europe and Japan, things are basically the same as the U.S., but in China, they are different. Correspondingly, there are three main problems in Chinese Patent Substantive Conditions： the first one is that ＂Significant Progress＂ of Creativity is redundant; the second one is that ＂to produce positive effects＂ of Utility should be abandoned; the third one is that ＂Unexpected Technical Effect＂ to judge Creativity is offside. Therefore, the solutions to these problems are to delete the requirements of ＂Significant Progress＂ of Creativity and ＂to produce positive effects＂ of Utility, and to retreat ＂Unexpected Technical Effect＂ as an auxiliary factor to judge Creativity.
