Comment on the Legal Value of the Securitization of Patent Assets

目前我国与专利资产证券化相关的担保、证券等法律制度,多是从经济学角度出发将专利资产证券化作为一种新型的融资方式来考量,没有关注到其与专利质押贷款和风险资本投资的区别特征。专利资产证券化的法学价值分析是对专利资产准确评估的前置程序,影响到专利资产的权利认定与合理配置,为保护投资者的合法权益,应尽快在我国建立切实可行的专利资产证券化的法学价值评估体系。

Abstract：as a new way of finance from the economic perspective. There is no attention payed to the distinct difference between the patent securitization and the patent pledge loan, so also does venture capital investment. The analysis of the legal value of patent securitization is a prepositional procedure for the accurate assessment of patent assets, which influences the cognition of the right and the rational allocation. To protect the right of the investors, China should establish a practical system for assessing the legal vallue of patent securitization.
