地票制度研究综述

Review of Land Quota Research

地票制度实施以来备受学术界高度关注,学界就地票制度的创新、存在的问题、改进措施等进行了广泛讨论。采用文献综述研究方法,在回顾地票制度研究现状基础上,对地票制度研究的一些热点问题进行辨析。研究结果表明:地票制度创新意义在于促进城乡资源的合理流动等;地票制度存在一定的问题,但可以通过在实践中不断调整政策解决;地票二级市场开放是必然趋势,但是必须认清二级市场开放的风险并制定风险规避策略;地票交易与土地流转有一定相似性,但不同于土地流转;"地票"翻译为"Land Coupon"更为合适;地票制度与土地发展权有一定差异,但并没有侵占落后地区的发展权。地票制度作为一种制度创新是值得肯定的,存在的问题需要在探索中不断完善。

The system of land quota has attracted attention from domestic academic field since it was implemented in 2008. This paper summarizes the researches on land quota and discusses the hot issues about the land quota to promote healthy development of the system using the method of documentation. The results indicate that a） the land quota has promoted reasonable flow of resources between urban and rural areas, b） some problems exist in land quota system which can be solved by adjusting policy in practice, c） it is an inexorable trend to establish the secondary market of land quota however, we must recognize the risks and construct the risk aversion strategy, d） land quota transaction is somewhat similar to but different from land circulation, e） land quota is different from land development rights, and f） land quota hasn＇t prevented the development right of the backward areas. It is concluded that the land quota system should be affirmed as an innovation and need to be improved in practice.
