解决医疗纠纷第三方处理模式的探索与创新——以国内外医疗纠纷解决的不同模式为视角

Exploration and Innovation on the Third Party Processing Mode on Medical Disputes:From the Perspectives of Different Medical Disputes Resolution Models in Domestic and Aborad

为探索医疗纠纷第三方处理模式的有效途径,深刻剖析医疗纠纷难处理的现状及其原因,在介绍目前我国的医疗纠纷第三方解决模式的基础上,对比分析了美国、日本关于医疗纠纷解决的主流模式,并对国内目前存在的医疗纠纷第三方处理机构进行归类,比较各自存在的优缺点,提出进一步完善的三点建议:推行强制医疗责任保险,注重纠纷处理与救济并重;多角度构建调解机制的公正程序保证结果公正,增强第三方处理机构的公信力;促进调解机构与专业团体合作,重视医疗纠纷的教育与预防。

To seek an effective the third party processing mode on medical disputes, through profound analysis of the present situation and reasons for the difficulties on dealing with medical tangle, on the basis of introducing our Chinese the third party processing mechanism, comparing with corresponding main trend in Japan and USA, this paper tries to classify existing the third party processing institutions on medical disputes, and compares merits and demerits among these institutions, and then promotes three main suggestions for the perfections of our Chinese the third party processing model on medical disputes： first, we should apply compulsory medical liability insurance, give equal emphasis to processing and relief; second, we should construct impartial mediating procedure to ensure justice of results, so as to enhance creditability of these institutions; third, we should promote cooperation between mediation organizations and professional societies, and attach importance to education and prevention on medical disputes.
