经济学视角下中国证券法实施中存在的问题分析

The Problems and Solutions in the Practice of Chinese Securities Law

中国证券法实施已七年多,资本市场运行的基础和内外部环境均发生了重大变化,故要求修改证券法的呼声也越来越高。关于证券法,学术界出现了许多高质量的研究成果,但大多关注的是证券监管制度和效率问题,视角较单一。本文以经济学的视角,从法律、监管、市场三者的关系中梳理出中国证券法实施中存在的主要问题,并提出今后修改和完善的方向。

Great changes have taken place in the capital market in the past seven years when Chinese securities law was in practice, so the voices to modify the securities law are becoming higher and higher. In academic community, securities supervision system and efficiency are concerned a lot. This paper sorts out the existing problems from the relationship of law, supervision and market and points out the developing direction in the angle of economics.
