开发区设置人大机构的必要性和可行性——以“管委会体制”模式为例

On the Necessary and Feasible Setting the Institutions of the National People's Congress in the Development Zones: Based on the Administration Committee System

我国各地相继成立了各级各类开发区管委会,对开发区行使经济事务和部分社会事务管理的职权。不仅如此,许多国家级开发区还设立了国家机关。为了保证和监督开发区管委会等国家机关正常运行,各级人大在国家级开发区基本都设立了人大联络处。开发区的健康成长,既要遵守经济发展的规律,也要符合法治的一般精神和基本的政治制度。但是,人大联络处对开发区的建设支持和监督力度是远远不够的,而且,这也与我国有关的法律相冲突。

In recent yeas, China has established many kinds of the administration committee in development zones, which authority is managing the economic affairs and parts of the social affairs. Furthermore, many national level de- velopment zones have set up state organs. In order to guarantee and supervise the normal operation of the administra- tive committee in development zones, many corresponding people＇ s congresses basically set up the National People＇ s Congress Liaison Office at all levels in national development zones. The healthy growth of the development zones should not only follow the rule of economic development, but also accord with basic political system and the general spirit of the law. However, the role of the National People＇ s Congress Liaison Office is not effective to support and supervision the construction of the Development Zones. Meanwhile, this is also conflicting with our country＇ s relevant laws.
