检察机关死刑执行监督问题研究

On the Monitor of executions of death Penalty by Prosecutor Administration

《人民检察院刑事诉讼规则(试行)》首次明确了死刑执行临场监督的部门,即由监所检察部门负责。从死刑执行的监督主体、监督内容以及发展与完善作了研究和分析,建议增加死刑罪犯的律师作为执行监督的主体并增加检察机关监督死刑执行的手段,以期不断增强死刑执行监督的力度和实效。

According to ＂People＇s Procurator Rules of Criminal Procedure （Trial）＂, the monitoring department of execution of death penalty is clearly identified for the fimt time, that is the prosecutor department in charge of the prison. In this paper, the subject of monitoring, monitoring content of monitoring as well as the improvement and the development are under research and analysis. It proposes that the criminal＇s lawyer work as one of the main subjects of execution and more means should be taken to monitor the execution of death penalty in order to continuously enhance the strength and supervision of execution effectiveness.
