摘要
"你们的法不过是被奉为法律的你们这个阶级的意志",这句话在中国法学界很流行。但是,从形式逻辑和语法上讲,这句话讲不通,令人费解。这句话译自《共产党宣言》1848年德文版,翻译上基本没错。对照由恩格斯亲自审定的1888年英文版考证,导致德文版费解的原因,可能是排字工将"法学"(Rechtswissenschaft)一词误排为"法律"(recht)了。
＂Your jurisprudence is but the will of your class made into a law,＂ this sentence has been very popular a- mong the Chinese legal community. However, it does not make sense in formal logic and grammar. This sentence was translated from the German edition of the Communist Manifesto （1848）, and the translation is basically correct. By chec- king the 1888 English edition approved by Engels, the German edition was problematice due to the typesetter＇s error by mis- taking ＂jurisprudence＂ （Rechtswissenschaft） for ＂law＂ （recht）.
