江苏省昆山市2012年餐饮行政处罚案件分析

目的：分析2012年昆山市餐饮行政处罚案件，对存在的问题进行客观评价，为监督执法部门提供建议。方法：通过文献资料法、逻辑分析法对190件餐饮行政处罚案件进行案件违法主体、违法种类、涉案案值及案由等内容进行分析。结果：违法主体中餐馆和企业食堂居多；处罚种类以罚、没款和没收违法产品居多；案值在2000元～10000元之间；案由主要集中在无餐饮服务许可证和标签标示不符合要求。建议：完善餐饮服务监督管理法律法规，加强监测和抽检工作，完善行政处罚后续物品处置措施，强化餐饮业监管相对人和监督员的培训，加强与公安部门的协作，加大大案要案的查处力度。

Objective： Analyzed the administrative penalty cases of in 2012 of Kunshan andevaluate the problems ob- jectively, to provide suggestion to the supervision and law enforcement. Methods： Analyzed 190 administrative penalty cas- es of catering industry to get the information of the cases about the subjects, kinds, reasons and the value of these offenses, through the literature consultation and logical analysis. Result： The biggest parts of the objective of the offenses are eater- ies and enterprises canteens; the most kinds of the administrative penalties are penalty and confiscating the illegal prod- ucts; the value of the most cases range from 2000 ~ to 10000 ~ ; and the main reasons of these cases are running without the catering service license and label does not meet the requirements. Suggestion： perfect laws and regulations of the super- vision and administration of catering service, strengthen monitoring and spot cheek, perfect the treatment measure of the goods of the administrative penalty, strengthen the training of the administrators of catering industry and the cooperation with police, investigate and treat the major case more rigorously.
