网络信息系统安全软件产业之法律监管分析

Legal and regulatory analysis on the network information system security software industry

运用实证分析法对我国网络信息系统安全软件产业目前所存在的问题进行分析,发现主要存在不正当竞争加剧、立法滞后、监管缺位、法律实施效率低下等不足。应当由立法机构和监管部门从提高法律实施效率的角度出发,健全网络信息系统安全软件产业的相关立法、完善产品的检测与管理机制、加大对行业内不正当竞争等违法行为的查处力度,建立网络信息系统安全产品行业管理规范与处理机制和诚信公示制度。

Empirical analysis is carried out on the use of network information system security software industry. Problems are found primarily in unfair competition, legislative lag, lack of su- pervision, and lack of law enforcement inefficient. It is suggested that a sound network informa- tion system security software industry-related legislation should be formed by the legislative bodies and regulatory authorities to improve law enforcement efficiency, to improve product tes- ting and management mechanism, to increase efforts to deal with such violations in unfair comPe- tition within the industry, and to establish a network information system security products indus- try management norms, a processing mechanism and a integrity public system.
