浅析医生执业过程中人身权利的保护

Analysis on Doctors' Human Rights Protection in the Process of Practice

近几年,医生在执业过程中人身权被伤害的事件屡有发生,这不仅挫伤了医生的工作积极性,也严重影响了医疗秩序。而导致这种情况发生的原因中,既包括一些显性因素,也有其深层隐性原因。针对这个问题,应从完善医生人身权保护立法、让医学人文精神回归临床、确保基本医疗服务作为政府所提供的基本公共服务落到实处、加强全社会的医学知识教育、加强纠纷的防范和处理力度以及提高医生的法律意识和能力等方面进行解决。

In recent years, it occurred frequently that doctors＇ human rights were hurt in the process of practice, which not only hurt doctors＇ work enthusiasm, but also seriously affected the medical order. And it resulted from some direct factors as well as some deep-rooted reasons. This problem should be solved from the following aspects： legislation perfection of doctors＇ human rights protection; the return of medical humanistic spirit to clinic; the implementation of basic medical service as the basic public services provided by the government; the strengthening of medical knowledge education of the whole society; the strengthening of disputes prevention and processing; and the promotion of doctors＇ legal consciousness and ability, etc..
