农村集体收益分配权研究

Rural Collective Income Distribution Rights

集体收益分配权应是农民享有的基本权利之一,但是由于法律法规对如何处理分配纠纷的规定不尽明确,导致该权利的行使受到了一定的限制。笔者从集体收益分配权产生的背景出发,分析该权利的性质,界定其主客体和内容,并对集体收益分配权的权利行使方式及保护应采取的相应措施提出合理的见解。集体收益分配权是我国农村集体组织在市场经济背景下发展到一定阶段的产物,其存在至少有三个必要前提,一是集体组织有可分配之财产;二是集体组织之"公"与其成员之"私"要有明晰的区分且相对对立;三是制度保障(法律保障)。
