农业保险法比较研究——兼评《农业保险条例》

Research on the Agricultural Insurance from the Perspective of Comparative Law

通过对美国、加拿大、日本、韩国、菲律宾、西班牙、葡萄牙及我国农业保险立法框架结构、农业保险立法目的与调整范围、农业保险经营模式与经营规则、农业保险合同制度、农业保险的管理和参与部门、财税支持制度、巨灾风险分散机制与再保险制度等的比较,对我国《农业保险条例》文本进行评析。分析认为《农业保险条例》的制定对开启农业保险的中国道路、实现农业保险法治化具有里程碑式的意义,但也存在定位不准、立法技术需改进等问题,需要继续完善。

The author compared the agricultural insurance legislations among America, Canada, Japan, Korea, Philippines, Spain, Portugal, Italy and China, concerning the legislative framework, the legislative purpose and adjustment range, the operating modes and rules, insurance contracts, related regulatory ministries and commissions, financial supporting systems and preferential taxation systems, the mechanisms on the catastrophe risks diversification, and the agricultural reinsurance systems. On the basis of the above comparison, the author made comments on the Regulation on the Agricultural Insurance. The Regulation on the Agricultural Insurance has great significance for China＇ s explorations on its agricultural insurance systems. For there still exist legislative deficiencies, the Regulation needs to be improved.
