Application of the Law Over the Foreign Moveables Real Right

本文探讨了涉外动产物权适用物之所在地法的历史沿革、适用范围及几种特殊动产物权的法律适用 ,指出从我国的实际情况出发 ,并借鉴其他国家的立法 ,应建立我国动产物权适用物之所在地法原则。

This thesis explores the evolving history about application of the local law which is adopted according to the location of the object in foreign moveables real right and the applicable areas and legal application of the some specific moveables real right .The author also suggests that our own legal principles about the application of the local law which is adopted by the location of the object in foreign moveables real right should be enacted considering our own practical situation and drawing on legislative exprierence of other countries.
